Content Removal and Intellectual Property
Report of content that infringes copyright, trademarks or other rights
If you believe that any content published on Sphere infringes your copyright, trademarks, image rights, privacy rights or any other legal rights, you may file a report following the procedure described below.
Data that the complainant must provide
- Identification of the complainant (full name, address, email and identification number).
- Identification of the reported content (link, unique identifier or exact location).
- Information about the infringed rights (copyright, trademarks, image rights, etc.).
- Proof of ownership or authorization for the use of the reported content.
- Information about the owner of the reported content, if possible.
Response timelines
Sphere will respond to the report within [5] business days after receipt. During this period, the reported content will be verified and the necessary measures will be taken for its removal, provided the legal requirements are met.
Temporary removal
In the event that Sphere considers that the reported content may infringe legal rights, it may temporarily remove the affected content until the verification process is resolved. This removal will be notified to the affected user.
Notification of the affected user
The affected user will be notified of the report and the possible removal of the content. They will be given the opportunity to respond or clarify the situation.
Right to respond and counter-notification
The affected user may submit a response or counter-notification within [5] business days from the notification. Sphere will evaluate the response and, if appropriate, resume the content or notify the complainant of the decision made.
Policy towards repeat infringers
Sphere will take disciplinary measures against users who repeatedly infringe intellectual property rights, including the temporary or permanent suspension of their account, as well as notifying the relevant authorities in case of serious violations.
Sphere's responsibility
Sphere acts as an intermediary and is not responsible for the delivery or compliance of the product, which is the seller's responsibility. Sphere is not part of the buyer-seller contract between the buyer and the seller, and has no responsibility for user-generated content, except in the cases provided for in applicable legislation.
